Understanding the NDIS Code of Conduct
The NDIS Code of Conduct sets out the expectations for providers and workers delivering NDIS supports and services. It exists to ensure the health, safety, and wellbeing of participants, and to promote the delivery of high-quality services.
Our Commitment to Each Code Element
1. Respect and Dignity
Code Requirement: Act with respect for individual rights to freedom of expression, self-determination, and decision-making.
How We Implement:
- We treat every participant as an individual with unique preferences and choices
- We support participants to make their own decisions about their care
- We communicate clearly and respectfully, adapting to each person's communication needs
- We never make assumptions about what a participant wants or needs
- We provide culturally appropriate and safe services
2. Privacy and Confidentiality
Code Requirement: Respect the privacy of participants and keep their personal information confidential.
How We Implement:
- We have comprehensive Privacy Policy procedures
- All staff sign confidentiality agreements
- Personal information is stored securely with restricted access
- We only share information with consent or when legally required
- Regular staff training on privacy and data protection
3. Honesty and Transparency
Code Requirement: Provide supports and services in an honest, transparent, and fair manner.
How We Implement:
- Clear, written Service Agreements before services commence
- Transparent pricing aligned with NDIS Price Guide
- Honest communication about what services we can and cannot provide
- No hidden fees or surprise charges
- Regular updates on service delivery and NDIS plan usage
4. Competence and Capability
Code Requirement: Provide supports and services competently and safely.
How We Implement:
- All staff complete NDIS Worker Orientation Module
- Role-specific training and qualifications verification
- Police checks and Working with Children Checks
- Ongoing professional development and supervision
- We only accept participants whose needs match our capabilities
5. Prompt Action on Risks
Code Requirement: Take all reasonable steps to prevent and respond to all forms of violence, exploitation, neglect, and abuse.
How We Implement:
- Zero tolerance policy for abuse, neglect, or exploitation
- Regular risk assessments for each participant
- Clear incident reporting procedures
- Immediate reporting to authorities when required
- Staff trained to recognise and respond to signs of abuse
6. Conflict of Interest
Code Requirement: Take all reasonable steps to prevent and disclose conflicts of interest.
How We Implement:
- Regular conflict of interest declarations by all staff
- Transparent disclosure of any potential conflicts
- We do not provide services where a conflict would compromise care quality
- Clear boundaries between personal and professional relationships
7. Gifts and Benefits
Code Requirement: Ensure that gifts or benefits do not influence the supports and services provided.
How We Implement:
- Gifts policy limiting acceptance of gifts from participants
- Small tokens of appreciation (under $25) may be accepted with manager approval
- No cash gifts accepted under any circumstances
- All gifts are declared and recorded
NDIS Practice Standards
In addition to the Code of Conduct, Livara Care complies with the NDIS Practice Standards, which include:
- Rights and Responsibilities of Participants
- Governance and Operational Management
- Provision of Supports
- Support Provision Environment
We undergo regular audits by the NDIS Quality and Safeguards Commission to ensure compliance.
Worker Screening Requirements
All Livara Care workers must meet these requirements:
- National Police Check (renewed every 3 years)
- Working with Children Check (where applicable)
- NDIS Worker Screening Check
- Reference checks
- NDIS Worker Orientation Module completion
- Ongoing training on the NDIS Code of Conduct
